Completed the sale of my flat in Brislington last December but our buyer keeps Skype messaging me to moan that her lawyer is waiting to hear from mylawyer. What are the post completion sale legalities following completion?
After completion of your house sale your conveyancer is obliged to deliver the transfer deeds and all of the paperwork to the buyer’s lawyers. If applicable, your lawyer must also confirm that the mortgage has been discharged to the buyers conveyancers. There are no post completion tasks unique to conveyancing in Brislington.
My aunt informed me that in purchasing a property in Brislington there could be a number of restrictions affecting the ability to carry out external alterations to the property. Is this right?
There are anumerous of properties in Brislington which have some sort of restriction or requirement of consent to execute external variations. Part of the conveyancing in Brislington should determine what restrictions are applicable and advising you as part of a ROT that should be sent to you.
Two weeks ago we had a mortgage agreed in principle with Santander. Brislington conveyancing practitioners are selected. What is the average time that one could expect to receive a mortgage offer from Santander?
There is no definitive answer here. Have Santander conducted the valuation? Have you advised Santander as to your lawyers' details and checked that your lawyers are on the Santander conveyancing panel? Sometimes it can take as long as six weeks for a mortgage offer to be issued.
I have paid off my mortgage with UBS. I assume I don't need a Brislington property lawyer on the UBS panel to remove the mortgage at the Land Registry. Am I right?
If you have finished paying off your UBS mortgage, they may send you evidence showing that you have paid it off. Alternatively they may notify the Land Registry directly. The Land Registry need to see this evidence before they will remove the UBS mortgage from the register. UBS, and any evidence they send you, will determine the action you need to take. In cases where no conveyancer is acting for you and you have paid off your mortgage:
- but are not moving to another property
- where UBS has sent the Land Registry the discharge electronically, and
- UBS has instructed the Land Registry to do so
It has been five months following my purchase conveyancing in Brislington completed. I have checked the Land Registry website which shows that I paid £150,000 when infact I paid £215,000. Why the discrepancy?
The price paid figure is taken from the application to register the purchase. It is the figure included in the Transfer (the legal deed which transfers the property from one person to the other) and referred to as the 'consideration' or purchase price. You can report an error in the price paid figure using the LR online form. In most cases errors result from typos so at first glance the figure. Do report it so they can double check and advise.
I decided to have a survey carried out on a house in Brislington ahead of retaining solicitors. I have been told that there is a flying freehold overhang to the property. My surveyor advised that some mortgage companies tend refuse to issue a mortgage on such a property.
It varies from the lender to lender. Bank of Scotland has different requirements for example to Nationwide. If you e-mail us we can look into this further via the relevant lender. If you lender is happy to lend one our lawyers can help as they are used to dealing with flying freeholds in Brislington. Conveyancing may be slightly more expensive based on your lender's requirements.
How can the Landlord & Tenant Act 1954 impact my business offices in Brislington and how can you help?
The 1954 Act provides protection to business lessees, granting the dueness to apply to court for a renewal lease and continue in occupation when the lease comes to an end. There are certain specified grounds that a landlord can refuse a lease renewal and the rules are complicated.
