We are nearing an exchange on a property in Pendlebury and my parents have sent the 10% deposit to my conveyancer. I am now advised that as the deposit has not come from me my solicitor needs to make a notification to my lender. Apparently, in also acting for the mortgage company he must advise them that the balance of the purchase price is coming from anyone other than me. I advised the lender regarding my parents' contribution when I applied for the home loan, so is it really appropriate for this now to be an issue?
Your lawyer is obliged to clarify with lender to make sure that they understand that the balance of the purchase price is not from your own funds. The solicitor can only disclose this to your lender if you agree, failing which, your lawyer must cease to continue acting.

As is the case with lots of service providers, often suggestions from family and friends can be very helpful. Nevertheless there are many parties with a keen interest in a conveyancing transaction; estate agents, mortgage brokers and banks may suggest lawyers to retain. Sometimes the conveyancers might be known to one of the organisations as being good in their field, but occasionally there might be a commercial relationship behind the endorsement. You are at liberty to appoint your preferred conveyancer. Don't forget that some banks operate an approved list of law firms you have to use for the mortgage related work in your home move.
My fiance and I may need to sub-let our Pendlebury 1st floor flat for a while due to a new job. We instructed a Pendlebury conveyancing firm in 2001 but they have since shut and we did not think at the time get any advice as to whether the lease permits subletting. How do we find out?
A small minority of properties in Pendlebury do contain a provision to say that subletting is only allowed with permission. The landlord cannot unreasonably withhold but, in such cases, they would need to see references. Experience suggests that problems are usually caused by unsatisfactory tenants rather than owner-occupiers and for that reason you can expect the freeholder to take up the references and consider them carefully before granting consent.
