We are close to exchanging contracts on the sale of our home in Padstow and the buyers lawyers are claiming that there is a possibility that the property was constructed land that was not decontaminated. As long as you have a registered title the details of your proprietorship will be recorded by HMLR with a Title Number. It is easy to perform a search at the Land Registry, find your house and obtain current copies of the property title for less than a fiver. If the property is Leasehold then the Land Registry will usually hold a file duplicate of the Registered Lease and again, a copy can be retrieved for a small fee.
Due to the encouragement of my in-laws I had a survey completed on a house in Padstow prior to instructing conveyancers. I have been told that there is a flying freehold aspect to the property. My surveyor has said that some banks may not issue a loan on this type of home.
