I purchased a freehold residence in Holmfirth but still invoiced for rent, why is this and what is this?

It is rare for properties in Holmfirth and has limited impact for conveyancing in Holmfirth but some freehold properties in England (particularly common in North West England) pay an annual sum known as a Chief Rent or a Rentcharge to a third party who has no other legal interest in the land.

Rentcharge payments are usually between £2.00 and £5.00 per year. Rentcharges date back many centuries, but the Rent Charge Act 1977 barred the generation of fresh rentcharges from 1977 onwards.

Old rentcharges can now be extinguished by making a one off payment under the Act. Any rentcharges that are still in existence in 2037 will be dispensed with completely.

I am expecting a AIP from Skipton this week so we can work out what to offer on a property we like as otherwise we are dependent on web based calculators (which aren't taking into account credit checks etc). Do Skipton recommend any Holmfirth solicitors on the Skipton conveyancing panel, or is it better to find our own lawyer?

You will need to appoint Holmfirth solicitors independently although you'll need to choose one on the Skipton conveyancing panel. The solicitor represents both you and Skipton through the process.

I have today made my last payment due on my mortgage with Aldermore. I assume I don't need a Holmfirth property lawyer on the Aldermore panel to discharge the mortgage at the Land Registry. Am I right?

If you have finished paying off your Aldermore mortgage, they may send you evidence showing that you have paid it off. Alternatively they may notify the Land Registry directly. The Land Registry need to see this evidence before they will remove the Aldermore mortgage from the register. Aldermore, and any evidence they send you, will determine the action you need to take. In cases where no conveyancer is acting for you and you have paid off your mortgage:

  1. but are not moving to another property
  2. where Aldermore has sent the Land Registry the discharge electronically, and
  3. Aldermore has instructed the Land Registry to do so
The Land Registry will send you a letter confirming that your Aldermore mortgage has been paid off.

Our offer on a property in Holmfirth has been agreed to, but there is a chain. The sellers have offered on somewhere, but it’s not yet agreed to, and are looking at other apartments booked. I have instructed a local conveyancing solicitor in Holmfirth. What do I do now? At what point do I apply for the mortgage with Principality?

It is normal to have apprehensions where there is a chain as you are unlikely to want to incur expenses prematurely (mortgage application is in the region of £1k, then survey, Holmfirth conveyancing search fees, etc). First, you must ensure that your solicitor is on the Principality approved list. Regarding the next stages this very much depends on the circumstances of your transaction, attraction to the property and on the state of the market. During a buoyant market some home buyers will apply for the mortgage with Principality and pay for the valuation and only if it was satisfactory would they pay their conveyancing practitioner to move forward with the conveyancing in Holmfirth.

Will our solicitor be making enquiries regarding flooding during the conveyancing in Holmfirth.

The risk of flooding is if increasing concern for conveyancers dealing with homes in Holmfirth. There are those who buy a house in Holmfirth, completely expectant that at some time, it may be flooded. However, aside from the physical damage, if a house is at risk of flooding, it may be difficult to get a mortgage, suitable building insurance, or dispose of the premises. Steps can be carried out as part of the conveyancing process to forewarn the buyer.

Lawyers are not qualified to impart advice on flood risk, but there are a numerous checks that may be undertaken by the purchaser or on a buyer’s behalf which will figure out the risks in Holmfirth. The conventional set of information supplied to a buyer’s lawyer (where the solicitors are adopting what is known as the Conveyancing Protocol) contains a usual inquiry of the seller to discover if the premises has historically flooded. In the event that flooding has previously occurred and is not disclosed by the seller, then a buyer could commence a compensation claim stemming from an incorrect reply. A purchaser’s lawyers may also order an environmental report. This should indicate if there is any known flood risk. If so, additional inquiries should be initiated.
