Am I correct in assuming that the fact that my conveyancer is not on the Yorkshire Bank Conveyancing panel that there is a problem with the standard of the firm’s conveyancing?
That would more than likely be a wrong assumption to make. There are all sorts of perfectly reasonable explanations. A recent report by the solicitors regulator indicated 76% of law firms surveyed had been removed from at least one lender panel. The top 3 reasons are as follows: (1) lack of transactions (2) the lawyer is a sole practitioner (3) as part of the HSBC panel reduction (4) regulatory contact by SRA (5) accidental removal. If you are concerned you should simply call the firm and ask them why they are no longer on the approved list for Yorkshire Bank.
My solicitor has identified a discrepancy when comparing the surveyor’s assumptions in Yorkshire Bank’s valuation report and what is revealed within the conveyancing documents. My lawyer informs me that as he is on the Yorkshire Bank conveyancing panel he must check that the lender is happy with this discrepancy and is content go ahead. Is my conveyancer’s approach right?
A precondition to being on the Yorkshire Bank approved panel is to comply with the CML Handbook requirements (last updated for this lender on Yorkshire Bank) which do require that your lawyer disclose any incorrect assumptions in the lender’s valuation report and the legal papers. Should you refuse to allow your lawyer to make the appropriate notification then your lawyer will have no choice but to discontinue acting for both parties.

You can use any solicitor you like but Yorkshire Bank then has the right to appoint a different solicitor to act for them at your expense. It might be more cost effective and quicker to instruct a lawyer who is on the Yorkshire Bank solicitors panel
Is there a list of Yorkshire Bank panel conveyancers on the CML Handbook Website?
No. There is no such tool on the Council of Mortgage Lenders or Building Society Association websites. Very few lenders make their panel listings available online.
Is it common for Yorkshire Bank to withdraw a mortgage offer and what would be the reasoning?
Lenders such as Yorkshire Bank can revoke their mortgage offer although this is unusual. should Yorkshire Bank withdraw their offer they may or may not inform you or the lawyer as to the reasons why. There are many potential reasons but here are a few examples:
- Where information comes to Yorkshire Bank ‘s attention regarding the customers or the security that they were not aware of prior to offer that affects their original decision to lend
- If the borrower informs Yorkshire Bank of a change in security address
- Amendments if purchase price adjusted and the loan to value limits exceeded by this. Please note that Yorkshire Bank conveyancing panel solicitors would be obliged to notify Yorkshire Bank of a change in the price of the property.
- Where the purchase price and borrowers direct contribution differ to details on the mortgage application form completed by the borrower
- Where the sale is not at arms length for value to unconnected persons
I have today made my last payment due on mortgage with Yorkshire Bank. I assume I don't need a solicitor on the Yorkshire Bank panel to remove the mortgage at the Land Registry. Please confirm
If you have finished paying off your Yorkshire Bank mortgage they may send you evidence showing that you have paid it off. Alternatively they may notify the Land Registry directly. The Land Registry need to see this evidence before they will remove the Yorkshire Bank mortgage from the register. Yorkshire Bank,and any evidence they send you, will determine the action you need to take. In cases where no conveyancer is acting for you and you have paid off your mortgage:

where the Yorkshire Bank has sent the Land Registry the discharge electronically, and
the Yorkshire Bank has instructed the Land Registry to do so
The Land Registry will send you a letter confirming that your Yorkshire Bank mortgage has been paid off.
