Topaz Finance’s conveyancing panel is substantial so it would be advisable to check with the firms you are getting quotes from whether they are on it. You can search by postcode on the search tool on this site to find solicitors that Topaz Finance will allow to act for them.
I do hope you can help me. My solicitor is informing me me that he has to order a Local Authority search as the firm are on the Topaz Finance conveyancing panel. Is this really necessary?
You have limited options available to you. As you are taking a mortgage with Topaz Finance your lawyer has to comply with their conditions as set out in their version of the CML Conveyancing Handbook. Your lawyer would have previously signed the Terms and Conditions of Topaz Finance’s conveyancing panel appointment which obliges them to follow the CML Handbook requirements last updated Topaz Finance. even if you were a cash buyer you would be ill advised not to carry out a local authority search.

Your lawyer has to follow the CML Handbook Part 2 requirements for Topaz Finance. Unless your lawyer obtains specific confirmation in writing that Topaz Finance will go ahead your lawyer has no choice but to refrain from exchanging contract and committing you to the purchase. We would suggest that you ask Topaz Finance to contact your lawyer in writing confirming that they will accept the remaining number of years left on the lease.
