Common questions asked concerning the Tesco Bank Conveyancing Panel
I am obtaining a offer of a mortgage from Tesco Bank. I intend to retain the legal services of a Licensed Conveyancer. Does the Tesco Bank Solicitor panel allow for conveyancers regulated by the CLC
Tesco Bank’s conveyancing panel is, like many other lenders associated to the Council or Mortgage Lenders or BSA, open to Licensed Conveyancers regulated by the Council of Licensed Conveyancers.
I am purchasing a brand new flat and my conveyancer is informing me that she is duty bound to disclose incentives from the developer as her practice is on the Tesco Bank conveyancing panel. The Estate Agents are hassling me to exchange contracts and I have no desire to delay the conveyancing. Is my lawyer right?
You should not exchange unless you have advised to do so by your lawyer. A precondition to being on the Tesco Bank approved panel is to comply with the CML Handbook requirements (last updated for this lender on Tesco Bank). The CML Conveyancing Handbook requires that your lawyer have the appropriate Disclosure of Incentive form completed by the developer and accepted by your lender.
I note that you have a post code search directory listing firms on the Tesco Bank conveyancing panel. Do firms pay you a referral fee if I retain them for my own conveyancing?
We are a listing service only for law firms wishing to communicate if they are on the Tesco Bank conveyancing panel or other lender panels. We do not charge referral fees to the any conveyancer that you subsequently appoint.
My lawyers in Leeds have advised me that no longer have my conveyancing file. To assist with my purchase I took out a mortgage with Tesco Bank. Is it case that being on the Tesco Bank conveyancing panel they need to have retained the file for a prescribed period?
Different lenders have different requirements but many of the Terms and Conditions of Conveyancing Panel Appointment require the file to be held for a period of 6 years. That being said we have not seen a copy of the Tesco Bank Conveyancing Panel Terms. It might be worth you contacting Tesco Bank directly.
We are getting a further advance on our mortgage from Tesco Bank as we wish to carry out a loft conversion to our home. Do we need to appoint a solicitor on the Tesco Bank conveyancing panel to deal with the paperwork?
Tesco Bank would not normally instruct firms on their conveyancing panel to deal with such a matter. If they did require any legal work then you would need to ensure that such a lawyer was on the Tesco Bank list
I was told three weeks ago that my mortgage has been agreed
to by Tesco Bank. Is it usual for Tesco Bank to only issue the offer once my
solicitor is approved on their conveyancing panel?
A lender would not issue a mortgage until they have details of a lawyer on their panel. It can take a few weeks for Tesco Bank to deal with your lawyers application to be on the Tesco Bank conveyancing panel. There's no guarantee that your solicitors will be accepted.
Tesco Bank have agreed my mortgage in principle, my offer on house has been accepted, now what?
The estate agent will want to know who your solicitors are (make sure these solicitors are on the lenders panel). Call up Tesco Bank or your broker and complete any relevant paperwork. Tesco Bank will tell you what documents they want. Tesco Bank will instruct a valuer. The valuer will get in touch with the estate agent or seller to book an appointment. Once conducted (assuming no problems) it takes about week to get a mortgage offer. Tesco Bank will issue the offer to you and your lawyer. The transaction will then take it’s course according the nature and complexity of the conveyancing.
