FAQs for the RBS - Direct Line Solicitor Panel

I have just been informed by my IFA that my solicitor is not on the RBS - Direct Line Solicitor panel. How can I be sure that this is correct?
The first thing you need to do is to contact your conveyancer. It is reasonable to expect your lawyer to advise you what has happened. If they are not on the panel they could put your in touch with solicitors on the the approved RBS - Direct Line solicitor panel.
I do hope you can help me. My conveyancer is assuring me that he has to order a Local Authority search as the firm are on the RBS - Direct Line conveyancing panel. Is my lawyer correct?
Unfortunately both you and your lawyer have little choice here. As you are taking a mortgage with RBS - Direct Line your lawyer has to comply with their conditions as set out in their version of the CML Conveyancing Handbook. Your lawyer would have previously signed the Terms and Conditions of RBS - Direct Line’s conveyancing panel appointment which obliges them to follow the CML Handbook requirements last updated RBS - Direct Line. even if you were a cash buyer you would be ill advised not to carry out a local authority search.

My grandmother passed away six months ago and as sole heir and executor was left the house. The house had a small mortgage remaining of approximately £4500. I want to have the title changed into my name whilst I re-mortgage to RBS - Direct Line , pay off the mortgage etc. Is this allowed?
If you intend to re-mortgage then RBS - Direct Line will insist on your using a conveyancer on the RBS - Direct Line conveyancing panel. Here is link to the Land Registry online guidance around what to do when a property owner dies. This will help you to understand the registration process behind changing the details re the registered title. in your case it would appear that you are effectively purchasing the property from the estate. Your RBS - Direct Line conveyancing panel solicitor pays the new mortgage money into the estate, the estate pays off the old mortgage, the charge is released and you become the owner and the RBS - Direct Line mortgage is registered as a charge at the Land Registry.
Can you point me to a directory of RBS - Direct Line panel conveyancers on the Council of Mortgage Lender’s Website?
No. There is no such tool on the Council of Mortgage Lenders or Building Society Association websites. Very few lenders make their panel listings available online.
I had instructed online conveyancers based in London who are on the RBS - Direct Line solicitor panel. They are now charging me a separate fee of £135 for the legal aspects of the RBS - Direct Line mortgage. Is this a supplemental conveyancing fee specified by RBS - Direct Line?
Unfortunately, as long as it is in their Terms and Conditions or Quote then yes your solicitors can charge a fee for this. This fee is not set by RBS - Direct Line but by your lawyers. Some firms on the RBS - Direct Line will charge an ‘acting for lender’ fee and others do not.
My ex -wife’s name is on the RBS - Direct Line mortgage of my property but not on the land registry. The apartment was transferred to me on our divorce many years ago by way of a sealed court order. Does my ex still have a say on the sale even though the land registry showing the property in my name alone? Will I be required to take her name of the RBS - Direct Line mortgage in order to sell?
As regards the RBS - Direct Line mortgage, it is unusual that your ex-wife’s name remains on the mortgage but not on the title. It is conceivable that this is an oversight on the part of your conveyancers to ensure that her name was removed or even an administrative error on the part of RBS - Direct Line in failing to update their data. In any event, it should cause difficulty providing her name no longer appears on the Land Registry title and you have a court order ordering that the property is transferred to you.
