I instructed a solicitor to conveyancing on my house purchase 4 weeks ago having applied for a mortgage with Adam & Company. The law firm confirmed to me that they are on Adam & Company conveyancing panel and advised me their panel number. Adam & Company then called me to say that their panel number was dormant and would need to be reactivated. What happens next? Do I instruct a different law firm listed on the conveyancing panel for Adam & Company?

Given that you are obtaining a mortgage with Adam & Company your lawyer must to check the Adam & Company conveyancing instructions contained in the Part of CML Handbook for Adam & Company . The CML Handbook contains minimum requirements for solar panel roof-space leases, and solicitors are required to report to Adam & Company where a lease does not meet these requirements. The requirements relate to the installation of panels on properties in England and Wales. The CML are developing guidance for Northern Ireland and Scotland.

Your lawyer has to follow the CML Handbook Part 2 requirements for Adam & Company. Unless your lawyer obtains specific confirmation in writing that Adam & Company will go ahead your lawyer has no choice but to refrain from exchanging contract and committing you to the purchase. We would suggest that you ask Adam & Company to contact your lawyer in writing confirming that they will accept the remaining number of years left on the lease.
