My partner and I intend to remortgage our flat in Hanworth with Barclays. We have a son 19 who lives with us. Our solicitor has asked us to disclose anyone over the age of 17 other than ourselves who lives in the flat. The solicitor has now sent a form for our son to sign, giving up any rights in the event that the apartment is repossessed. I have a couple of concerns (1) Is this form unique to the Barclays conveyancing panel as he did not need to sign this form when we bought 5 years ago (2) Does our son by signing this extinguish his entitlement to inherit the property?
On the face of it your lawyer has done nothing wrong as it is established procedure for any occupier who is aged 17 or over to sign the necessary Consent Form, which is purely to state that any rights he has in the property are postponed and secondary to Barclays. This is solely used to protect Barclays if the property were re-possessed so that in such circumstances, your son would be legally obliged to leave. It does not impact your son’s right to inherit the apartment. Please note that if your son were to inherit and the mortgage in favour of Barclays had not been discharged, he would be liable to take over the loan or pay it off, but other than that, there is nothing stopping him from keeping the property in accordance with your will or the rules of intestacy.
Will my conveyancing lawyers need to check that the building insurance for my purchase of a house in Hanworth. My lender is Platform
Platform have specific requirements as set out in the UK Finance Lenders’ Handbook. As of 24/1/2026, the requirements read as follows :
Is it necessary to pay for insurance to protect me from financial exposure to chancel repairs when purchasing a house in Hanworth?
Unless a previous acquisition of the property completed post 12 October 2013 you could assume that lawyers carrying out conveyancing in Hanworth to continue to suggest a chancel search and or chancel repair liability policy.
Over the last few months I have been searching for a leasehold apartment up to £195,000 and identified one near me in Hanworth I like with a park and railway links in the vicinity, the downside is that it only has 61 remaining years left on the lease. I can't really find anything else in Hanworth for this price, so just wondered if I would be making a mistake purchasing a short lease?
Should you require a home loan the remaining unexpired lease term will likely be problematic. Discount the price by the amount the lease extension will cost if it has not already been discounted. If the current owner has owned the premises for at least twenty four months you may ask them to start the process of the extension and then assign it to you. An additional ninety years can be extended on to the current lease with a zero ground rent applied. You should speak to your conveyancing lawyer concerning this.
How straightforward is it to use your search facility to locate a conveyancing practitioner in Hanworth on the panel for my bank?
Step one is to select a mortgage company such as National Westminster Bank, The Mortgage Works or Barclays Direct then specify your location e.g. Hanworth. Conveyancing firms in Hanworth and nationally should be identified.
