I am purchasing a leasehold flat in Fitzrovia. My Solicitor is not listed on the lender approved panel. Is it possible for me to continue with my Fitzrovia conveyancing solicitor notwithstanding that they are excluded from the lender approved list?
You have a couple of alternatives open to you here
- Complete the deal with your existing Fitzrovia solicitor but your lender will undoubtedly instruct a lawyer on their conveyancing panel. This will result in additional cost and potential delay.
- Get a fresh property lawyer to act in the purchase, obviously checking they are on the bank conveyancing panel.
- Appeal to your lawyer to attempt to join the mortgage company panel

Anti-terror and anti-money-laundering laws require solicitors and licensed conveyancers to check the identity of the potential client they are dealing with before they can accept their conveyancing instruction. The Terms of Engagement that you are required to sign will no doubt reaffirm this. Your lawyer also has obligations to obtain certain documents in accordance with the CML Lenders Handbook requirements last updated on 1st December 2014. Should you refuse to supply identification documents, your conveyancer would not be able to accept instructions from you.
My wife and I have a 4 bedroom Victorian house in Fitzrovia. Conveyancing practitioner represented me and Godiva Mortgages Ltd. I happened to do a free search for it on the Land Registry database and there are two entries: one for freehold, the second leasehold under the exact same address. Is it worth asking Godiva Mortgages Ltd to clarify?
You need to read the Freehold register you have again and check the Charges Register for mention of a lease. The best way to be sure that you are also the registered proprietor of the leasehold and freehold title as well is to check (£3). It is not completely unheard of in Fitzrovia and other locations in the country and poses no real issues for owners other than when they buy they have to account for both freehold and leasehold interests when dealing with buyers. You can also enquire as to the position with your conveyancing lawyer who conducted the purchase.
I decided to have a survey carried out on a property in Fitzrovia prior to retaining lawyers. I have been advised that there is a flying freehold aspect to the property. Our surveyor has said that some mortgage companies may not issue a loan on a flying freehold house.
