My wife and I are buying a newly constructed flat in Clun and my lawyer is telling me that she is duty bound to the bank to disclose incentives from the developer. I am under pressure to exchange and I don't want to prolong matters. Is my lawyer right?
You should not exchange unless you have been advised to do so by your lawyer. A precondition to being on a mortgage company panel is to comply with the UK Finance Lenders’ Handbook requirements. The CML Conveyancing Handbook requires that your lawyer have the appropriate Disclosure of Incentive form completed by the developer and accepted by your lender.

Where there is an Undertaking being granted there is the risk of forfeiture of the Headlease subject to relief if one or more of the Underlessees are willing to accept the original Head Lessee’s obligations as otherwise relief will be denied to the Underlessees. The only alternatives are the Head Lessor agreeing not to forfeit the Headlease or the Head Lessee guaranteeing to the Underlessees that it will not be in breach of the Headlease. Please provide evidence that the form of Lease proposed has been approved by the Land Registry. The Landlord must covenant to assume the management if the Management Company goes into liquidation or otherwise defaults in running the management scheme. Will control of the Management Company (if any) be handed over to purchasers on completion of the last sale or earlier? The Lease must contain a provision on behalf of the Vendor to pay the service charges in respect of unoccupied units in order to ensure that all services can be provided.

My partner and I are acquiring a garden flat in Clun. When we first instructed solicitor, they told us that they were on all mainstream lender panels. The financial adviser called just now to advise that they don't seem to be on the Santander approved list. Were it to be true, what should we do? Should we just pick a different solicitor that is on their panel or should we cover the costs for separate representation, with Santander appointing their own preferred solicitor.
If you are acquiring a property needing a mortgage it is usual for the buyer’s lawyers to also act for the purchaser's lender. In order to act for a bank or building society a conveyancer has to be on that lender's conveyancing panel. An application has to be made by the lawyer to the lender to become a member of the lender's panel and there are increasingly strict conditions which the conveyancer has to meet. Some banks now require their panel firms to be part of the Law Society’s Conveyancing Accreditation Scheme. Your lawyer should contact Santander to discover if they can apply for membership of their conveyancing panel, but if that is not viable they will instruct their own lawyers to represent them. You are not legally obliged to appoint a law firm on Santander's conveyancing panel as you are at liberty to use your preferred Clun lawyers, in which case your legal fees may increase, and it may delay matters as you are adding another conveyancer into the equation.
