We are purchasing a newly built apartment in Bingham and my lawyer is advising me that she is duty bound to the bank to disclose incentives from the developer. I am under pressure to exchange and I would rather not prolong the conveyancing. Is my lawyer right?
You should not exchange unless you have been advised to do so by your lawyer. A precondition to being on a lender panel is to comply with the UK Finance Lenders’ Handbook requirements. The CML Conveyancing Handbook requires that your lawyer have the appropriate Disclosure of Incentive form completed by the developer and accepted by your lender.
We are buying a apartment in Bingham. It might be a silly question but how we can trust a conveyancer? On the day of competition we have to put our life savings into their account. What protection do we have from them run away with our money?
Be assured that all money in a Solicitors client account is 100% safe, and even if your Solicitor ran off with it, the Law Society would reimburse you fully.
Forgive me if this question is silly but I am unexperienced as FTB of a garden flat in Bingham. Do I collect the keys to the property on the completion date from my lawyer? If so, I will find a High Street conveyancing solicitor in Bingham?
On the day of completion you will not be required to attend the conveyancers office in Bingham. Conveyancing lawyers for you will electronically transfer the purchase money to the vendor’s lawyers, and shortly after the monies have arrived, you will be invited to collect the keys from the selling Agents and start moving into the property. Usually this happens between 1 and 3pm.
After shopping around on the internet I have found a Bingham conveyancing practitioner having made sure that they are on the Aldermore conveyancing panel. Does my lawyer arrange the survey of the property?
Aldermore will need an independent valuation of the property. Your lawyer will not arrange this. Usually Aldermore will appoint their own surveyor to do this, and you will have to pay for it. Remember that this is a valuation for mortgage purposes and not a survey. You may wish to consider appointing your own Bingham surveyor to carry out a survey or prepare a home buyers report on the property. It is up to you to satisfy yourself that the property is structurally sound before you buy it. If the survey or report reveals that building work is needed, you should tell your solicitor. You may wish to renegotiate with the seller.
